ACCESS TO LAWPHONE FOR SELECTED ALLIANZ BROKERS*

*By invitation only

This promotion is open to invited brokers only who are based in Great Britain and Northern Ireland.

To claim access to the Lawphone commercial legal advice helpline (“Lawphone”), eligible brokers must be authorised to introduce certain classes of general insurance business under an active agency agreement with Allianz Insurance Plc during the promotional period.

This promotion is available until:

    a) 23:59 on 31 October 2024;

    b) the date the broker’s agency agreement terminates with Allianz Insurance Plc; or

    c) the date on which Allianz gives written notice of the withdrawal of the promotion to the broker,

(whichever is earliest).

Lawphone is provided by Allianz Legal Protection, part of Allianz Insurance plc (“Allianz”).

The telephone number to call Lawphone is 01483 260884. Calls to this number will often be included in any applicable call packages, otherwise calls will be charged at the standard network rate. No liability can be accepted for inability to provide advice due to breakdown or failure of the telephone network.

When calling for legal advice, eligible brokers will need to provide the policy number provided in the launch communication. The eligible broker should also have ready:

    1. Their contact information, including broker name, address and telephone numbers; and

    2. A brief summary of the problem requiring advice.

Legal advice is available for business matters only, related to the business activity of the brokerage.

Only phone based legal advice is included, this promotion does not extend to legal expenses insurance or any other advice or services.

If Lawphone advises that specialist in-depth advice is required, this is not included in the promotion and the broker may be advised to obtain independent legal advice at its own cost.

There are no limits to the number of times the broker can use the Lawphone advice line during the promotional period.

Before contacting Lawphone, eligible brokers should check they don’t have existing legal expenses cover with legal advice included with another insurer or purchased as part of a standalone policy. If such cover is available that cover should be used instead of Lawphone. Using Lawphone when you have another legal expense policy in place could jeopardise the broker’s cover under that other policy.

Using Lawphone to obtain legal advice for clients is explicitly excluded. If the broker’s client is an Allianz Commercial insurance policyholder, they may already have legal expenses insurance with Allianz. Those clients can get in touch with Allianz Legal Protection by contacting the Lawphone Legal Advice Helpline directly – details can be provided on request.

Legal advice is limited to Great Britain & Northern Ireland.

Lines are open 24 hours a day, 7 days a week.

REGULATORY RESPONSIBILITIES

Nothing in this promotion or these Terms and Conditions shall obligate the broker to place general insurance business or any particular policy with Allianz in any circumstances where to do so would not be in the best interests of the broker’s customers. By taking up this offer the broker is not giving any warranty or undertaking to Allianz as to the value of business which may be placed by the broker with Allianz. Accepting this offer does not require the broker to place general insurance business, or any particular insurance policy, with Allianz, in particular where the broker could offer a different insurance policy, from Allianz or another insurer, which would better meet that customer's needs.

In accepting these Terms and Conditions the broker confirms that such acceptance, and use of the Lawphone, will not prevent the broker’s compliance with all relevant laws, rules, regulations and codes of practice in force from time to time, and in particular but without limitation the Financial Services and Markets Act 2000, the Financial Services Act 2012, the Financial Conduct Authority (“FCA”), the Money Laundering Regulations 2017 or the Bribery Act 2010.
The broker will not place itself in a position where by accepting these Terms and Conditions to access the promotion might conflict with its obligation and duty to its customers from a regulatory or legal perspective (including its duties as agent under common law). Nothing in these Terms and Conditions shall override the broker’s duty to act honestly, fairly and professionally in accordance with the best interests of its customers. The broker must treat its customers fairly at all times in accordance with the FCA rules and in particular the requirements of Fair Treatment of Customers stipulated by the FCA.
The broker must have in place a conflicts of interest policy in accordance with the regulatory requirements including procedures and controls to identify and manage any potential, actual, perceived or alleged conflicts of interest.
The broker must have in place documented procedures and controls to identify and manage the soliciting or acceptance of unfair inducements where this would conflict with the broker’s duties to customers, including the duty to act honestly, fairly and professionally in accordance with the best interests of customers.  The broker should consider and manage information about the promotion for those staff responsible for the placement of business to avoid any influence or incentive for them to place business as a result of the promotion. It is the broker’s responsibility to determine whether an inducement is or could be unfair and conflicts to any material extent with a duty which the broker owes to its customers.
The broker agrees to comply with its regulatory requirements and make appropriate disclosure to customers of remuneration paid or payable to it by Allianz in accordance with its regulatory obligations and industry guidance, including the nature and basis of any remuneration payments and economic benefits in kind to customers in good time before the conclusion of their initial insurance policy and, if necessary, on its amendment or renewal.

Allianz shall be entitled at its absolute discretion to disclose the offering of this promotion to the broker as a benefit in kind to any policyholder or customer where such information is requested by that policyholder or customer, or is required to comply with regulatory requirements.

Each of the broker and Allianz:

a) shall comply with all applicable laws, regulations, codes and sanctions relating to anti-bribery and anti-corruption including but not limited to the Bribery Act 2010 and shall not engage in any activity, practice or conduct which would constitute an offence under the Bribery Act 2010 (regardless of where such activity, practice, or conduct is carried out);
b) shall not offer or give, or agree to give, to any employee, agent, servant or representative of the other party any gift or consideration of any kind as an inducement or reward for doing, refraining from doing, or for having done or refrained from doing, any act in relation to this promotion or the placement of general insurance business, or for showing or refraining from showing favour or disfavour to any person in relation to any such activities;
c) shall have in place adequate procedures designed to prevent persons employed by or associated with that party from bribing another person;
d) shall promptly report to the other party any request or demand for any undue financial or other advantage of any kind received in connection with this offer or the placement of general insurance business; and
e) each warrants that it has not paid sales commission or agreed to pay any sales commission to any employee or representative of the other party in relation to this promotion.

The broker may not transfer or assign its rights or obligations set out in these terms in whole or in part.

This offer is not valid in conjunction with any of our other promotions.

We reserve the right to change these Terms and Conditions of this offer by amending these online.

This promotion and these Terms and Conditions of entry are governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with this promotion and you agree they are a convenient forum for you.
